Terms
This is how working with LAB59 goes, in plain English. No tricks, no fine print hiding in a footnote.
What we agree by email before I start is the main agreement. If it says something different from this page, the email wins.

Who you're dealing with
LAB59 is a Brisbane business run by me, Gary Titmarsh, as a sole trader. When this page says "I" or "LAB59", that's me. When it says "you", that's you, or the business the site is for.
LAB59 is not currently registered for GST. Prices for any optional extras are in Australian dollars.
What you get
A simple, fast website for your business, up to 3 pages, built at no charge. Before I start, I'll confirm by email what's included.
If you want something beyond that, like extra pages or having your Google Business Profile set up for you, I'll tell you first and give you a price. Nothing is charged without your OK.
The draft, and changes
I build a draft of your site first and send you a private preview link. Before you decide, one round of changes to the draft is included. If you go ahead, you get one more round to tidy things up before launch.
A round means tweaks to what I've already built, like wording, photos, colours or layout of a page. A completely different direction or a lot of new pages is extra work, and I'll talk it through with you first.
What I need from you
- Your text, photos, logo and business details, or enough information for me to write them with you.
- Confirmation that you have the right to use everything you send me. That means photos you took or paid for, and words that are yours.
- Replies in reasonable time. If things go quiet on your end, the finish date moves.
Dates I give you are my best estimate, not a fixed deadline, unless we've agreed otherwise in writing.
Checking before it goes live
Before launch, I'll send you the site to review. Please read it properly: spelling, prices, opening hours, phone numbers, addresses and anything that makes a claim about your business. You know these details better than I do. Once you've given the go-ahead, I'll publish what you approved.
Cost
The core site is free. There's nothing to pay before, during or after the build, and no contract. If you decide the draft isn't for you, walk away and I'll take the preview down.
Optional extras, like more pages or add-ons, are only charged if you ask for them and agree to the price first. I'll invoice for those once they're done, and invoices are due by the date shown on them. If you stop that extra work part-way through, you pay for what's been done up to that point. If you're owed a refund, you'll get it. Your rights under Australian law always apply, and nothing here cuts them down.
Who owns what
Once your site is live, the finished website and everything I made specifically for you is yours.
I keep ownership of my own tools, templates, code I reuse across projects and general know-how. Fonts, images and other third-party material stay under their own licences.
You keep ownership of everything you give me. You let me use it to build and run your site, and nothing more.
Hosting, domains and handover
Your site is kept deliberately simple, so there's no database, no logins and no plugins to keep updated. It's hosted on Cloudflare, and there's no hosting charge from me.
You should own your domain name, in your name, with your login. If I register one for you, it's registered to you, and I'll give you the details.
Once your site is live, I'll hand over the site files whenever you ask. If you want the site moved to hosting accounts of your own, I'll help, and I'll tell you first if it's more than a quick handover.
Cloudflare, GitHub, Google and other platforms are outside my control. They can go down, change prices or change their rules. If something changes that affects your site, I'll tell you and we'll work out the options together.
Your Google Business Profile
Where I help with your Google Business Profile, it stays yours, in your name, with you as the owner. Google decides what gets verified and what the rules are, and I can't speed that up or overrule it.
After launch
If something I built doesn't work the way we agreed, I'll fix it at no charge.
If you want content changes later, like new text, new photos or a new page, I can do them for a small fee, or you can leave the site as it is. I'll give you a price before I start. Because the site is so simple, you don't need to keep paying for maintenance just to keep it online.
No promises about results
A clear website and a well-kept Google Business Profile make it easier for people to find you and trust you. I can't promise a particular number of calls, customers, sales or a Google ranking. Too much of that depends on things I don't control, like your market, your prices, your competitors and Google itself.
Showing my work
The site is free because I'm building a portfolio. Once it's live, I'd like to show it on lab59.com.au and to other businesses, with screenshots or a link, and if you're happy with the result, I'll ask for an honest Google review. If you'd rather I didn't show your site, tell me and I won't.
Your information
I only use what you give me to do the work for you. I keep it private, I don't sell it, and I only share it with others where it's needed to build or run your site, like hosting, or where the law requires it.
Australian Consumer Law
Nothing on this page limits any right or remedy you have under the Australian Consumer Law or any other law that can't be excluded. That includes your right to services provided with due care and skill.
Liability
I take care with every site I build. To the extent the law allows, I'm not liable for indirect losses I couldn't reasonably have foreseen, such as lost sales. I'm also not responsible for problems caused by information you supplied, by changes someone else made to the site, or by outages on third-party platforms.
If we disagree
Talk to me first. Email me what the problem is and what you'd like to happen, and I'll do the same. Most things get sorted that way. This doesn't stop either of us from using any legal right we have.
These terms are governed by the law of Queensland, Australia.
Changes to this page
I may update these terms from time to time. The version in place when we agree the work by email is the one that applies to that job.
